Navigating and Negotiating in a Shifting Licensing Landscape

Each year more libraries are replacing or supplementing hard copy materials with online databases, electronic encyclopedias, Web based journal subscriptions and e-books. Some favorite materials are now available only in electronic formats. Instead of following the familiar acquisition process, librarians and administrators must now negotiate complex licensing agreements with publishers and information aggregators. Building electronic collections takes you into the new world of digital exclusions to first sale rights, UCITA, DMCA, WIPO and a host of emerging royalty issues. Adding to the complexity is a rapidly shifting vendor environment, with frequent mergers, corporate consolidations and occasional failures. We are all learning as we go... publishers, database providers, authors, lawyers, and librarians.

Workshop Description: This one day workshop will give you practical tools to help you evaluate vendor offerings, interpret proposed contract terms and negotiate mutually beneficial license agreements with confidence. We'll look at the library's responsibilities for contract compliance by patrons and staff, and we'll review best practices. You'll take away a deeper understanding of where and how negotiation fits into the electronic resource acquisition process, how to prepare, what the provider will put on the table, what you can offer, and various ways to approach the new pricing and usage paradigms..
